Fondetto Terms of Service
Last updated: 13 October 2026 (before the first release)
These terms are an agreement between you, the Shopify merchant who installs Fondetto ("you"), and Vitalcore Research Inc., doing business as Nolarine, 30 N Gould St, Ste R, Sheridan, WY 82801, USA ("we", "us"). By installing or using Fondetto ("the App") you agree to them. If you don't agree, don't install the App.
1. What the App does
The App uses AI to build your store's design, pages, menus, product copy and translations from the brief and products you give it. It works on an unpublished copy of a Shopify theme in your theme library, and changes your live store only when you publish that copy yourself or press Apply on proposed product text. Everything it builds is ordinary Shopify content that belongs to you and stays in your store if you stop using the App.
The App is a tool that drafts content; it is not a designer, copywriter, lawyer or adviser, and we are not a party to your sales. We never hold your or your customers' money.
2. Your responsibilities
You are responsible for your store and your sales, including:
- Complying with the laws that apply to you in every place you sell.
- Reviewing what the App writes before it goes live. AI can make mistakes. You decide what to publish and apply, and you are responsible for your store's content once it is live, including product claims, prices, sizes, materials and anything that needs to be true or legally allowed where you sell.
- Giving the App only facts you may use in the brief, in products and in images: content you own or are allowed to use. Don't ask the App to copy other stores or brands.
- Your store's legal policies (refund, privacy, terms, shipping). The App links to Shopify's own policy tools and does not write them.
- Keeping a copy of anything you want to keep before you delete or replace it outside the App.
- Keeping the information you enter in the App accurate.
You must not use the App for anything Shopify's terms don't allow, or for anything illegal.
3. Shopify
The App runs on Shopify and depends on Shopify's services, APIs and approvals. Your use of Shopify is governed by Shopify's own terms. We are not responsible for Shopify's services, outages, decisions or changes, including changes that affect what the App can do.
4. Plans, fees and trials
- Paid plans are billed by Shopify on your Shopify invoice through Shopify's billing system. Prices are shown in the App and on our App Store listing.
- We never charge a fee or commission on your sales.
- Paid plans include a free trial as stated on the listing. Each store gets one free trial; reinstalling the App continues the same trial rather than starting a new one. You can switch plans at any time on the App's Plan page. To cancel, use Cancel plan on the App's Plan page, or uninstall the App (Shopify admin, Settings, Apps, Fondetto, Uninstall); Shopify then stops billing for it. What the App built stays in your store.
- If you ask us at support@nolarine.com within 7 days of a charge, we refund that charge without questions. Other fees are not refundable except where the law requires or Shopify's billing rules provide otherwise.
- Each plan has monthly limits (for example the number of whole-store builds), shown in the App and on the listing. When you reach one, the App tells you and the date it resets; you are never charged extra for usage.
- If we change our prices, your current subscription keeps its price; new prices apply only to new subscriptions. We announce price changes in the App at least 30 days ahead.
5. Data and privacy
Our handling of personal information is described in the Fondetto Privacy Policy. The App does not access your customers' information. The App sends your brief, product details and instructions to our AI provider to write your store; neither we nor the provider use them to train AI models. Don't put information about other people into the brief unless you are allowed to share it with us.
6. Availability and support
We work to keep the App running and to fix problems promptly, but the App is provided "as is" and "as available". We do not guarantee it will be uninterrupted or error-free. We provide support by email at support@nolarine.com.
7. Limitation of liability
To the fullest extent the law allows:
- We are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, sales, data or goodwill.
- We are not liable for the acts or omissions of Shopify, other service providers or your customers.
- We are not liable for content the App generated that you published or applied, for changes you or others make in Shopify's theme editor, or for changes Shopify makes to its themes, apps or services. The App keeps copies so you can undo its own changes, but it is not a backup of your store.
- Our total liability for all claims relating to the App is limited to the fees you paid us for the App in the 12 months before the claim.
Some places don't allow these limits, so they may not fully apply to you.
8. Indemnity
You agree to defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from your store, your sales, your policies, your use of the App, or your breach of these terms or the law.
9. Ending the agreement
You can stop using the App at any time by uninstalling it. We may suspend or end your access if you breach these terms or misuse the App, or if we stop offering the App, with reasonable notice where possible. Sections 2, 7, 8 and 10 survive.
10. General
- Governing law: the laws of the State of Wyoming, United States, without regard to conflict of laws rules. The state and federal courts located in Sheridan County, Wyoming have exclusive jurisdiction, unless the law gives you the right to bring proceedings elsewhere.
- We may update these terms. We will post changes here and notify you in the App; continuing to use the App after a change means you accept it.
- If any part of these terms is unenforceable, the rest still applies.
- These terms and the Privacy Policy are the whole agreement between us about the App.
